O.C. deputy convicted of falsifying reports

SANTA ANA – An Orange County sheriff's deputy was convicted Tuesday of eight misdemeanor counts of filing false reports for claiming he contacted property crime victims and reporting that they did not wish to cooperate with DNA testing.

The jury of seven women and five men also found Jason Christopher Brant, 33, not guilty of four similar counts and deadlocked on five others.

Brant now faces a potential one-year term in the Orange County Jail at his sentencing by Superior Court Judge Richard J. Beacom on Jan. 16.

One of the jurors told Beacom that he hoped the judge would consider Brant's clean record as a deputy sheriff for 10 years before imposing sentence. Two other jurors said they felt Brant had been let down by his supervisors in the Sheriff's Department.

Defense attorney Paul S. Meyer argued during the nine-day trial that Brant's reports in the 17 cases were preliminary and that he never had the chance to modify the information before they were submitted to the District Attorney's Office.

Deputy District Attorney Tammy Spurgeon argued that Brant, of Chino, failed to contact some of the reported victims and falsely reported that others did not wish to cooperate when in fact they did.

Brant, a 10-year veteran, was one of several deputies assigned to follow up on 500 property crime cases as part of a federal grant given to the Orange County Sheriff's Department, working with the District Attorney's Office.

Allegations of Brant's misreporting deepened a rift between the Sheriff's Department and District Attorney Tony Rackauckas over who should lead the county forensics lab, then run by the sheriff's office. It is now run by the sheriff, the district attorney and the county chief executive officer.

The grant from the National Institute of Justice was aimed at measuring the effectiveness of DNA evidence in solving property crime in south Orange County. But the feuding between the Sheriff's Department and Rackauckas – ignited in part by allegations of false reports – hampered the outcome of the federally funded study.

Brant was responsible for contacting 39 victims of unrelated property crimes that occurred from 2005 to 2007.

Investigators with the District Attorney's Office reviewed Brant's files and found discrepancies in his reports, according to district attorney's spokeswoman Farrah Emami.

He was placed on administrative leave after the discrepancies were uncovered.

Man pleads guilty to threatening prostitute with fake gun:

Roberto Velazquez was arrested in Fountain Valley Tuesday after a prostitute flagged down a police patrol car saying that he had threatened her. Velazquez pleaded guilty to one count of felony false imprisonment and one count of misdemeanor brandishing a weapon, said his attorney Jeffrey Stivers. However, the district attorney dropped one felony count of assault with a deadly weapon, which would have been a strike, Stivers said. Velazquez's felony false imprisonment charge could be reduced to a misdemeanor if he successfully completes three years of probation and a 90-day jail sentence. The prostitute told police Velazquez had asked her for oral sex and drove off with her. But instead of paying her before hand, Velazquez reportedly pulled out a pellet gun and demanded oral sex from her. Police said the prostitute was able to escape. Read entire article

CRIMINAL LAW

FELONIES:

State criminal codes may call a crime an "aggravated" or "gross" misdemeanor, but if the offense calls for a sentence of more than one year of incarceration or punishment in the State Prison, those crimes will be treated as a felonies. Police get MADD awards for DUI arrests

About 350 officers showed in Yorba Linda for a special luncheon.

YORBA LINDA – The Orange County chapter of Mothers Against Drunk Driving honored local law enforcement at a luncheon and awards ceremony at the Nixon Presidential Library & Museum on Thursday.

About 350 uniformed officers dined on barbeque chicken, potatoes and coleslaw as 24 of their fellow officers were given the 2009 Century Award for making 100 or more arrests for suspicion of driving under the influence during 2008.

A dozen prosecutors also received the 2009 Diligent Prosecution Award for their work in DUI convictions and drunk driving deaths.

"It's always been very important for us to show our appreciation for our public agencies who are partners in eliminating drunk driving," said Gail Butler, executive director of the Orange County chapter.

Officers who received the Century Award made 100 or more arrests for suspicion of driving under the influence.

Motorcycle officer Tai Huynh of the Huntington Beach Police department received the quadruple Century Award for making 445 DUI arrests in one year.

During the luncheon, a presentation was given for Carla Olson, a Yorba Linda woman who was killed by a drunk driver in 2003. Her family was there for the presentation.

"Her story is tragic. She was killed in the prime of life, but her family has embraced MADD to cope with their loss," Butler said.

The officers applauded for the family.

Lori Muir – who survived a drunk-driving collision – received the heart of MADD award for her 10 years of volunteerism with MADD and her work at the Laguna Niguel victim impact panel.

In 1998, Muir was hit by a drunk driver and lost her left leg. After she told her story from her wheelchair, the crowd of uniformed officers gave her a standing ovation.

The Orange County Sheriff's Department will conduct roving patrols tonight in Mission Viejo, Rancho Santa Margarita and Lake Forest. The patrols will target areas with high rates of DUI arrests and accidents.

Obama ‘Hope' poster artist is arrested


BOSTON

A street artist famous for his red, white and blue “Hope” posters of President Barack Obama has been arrested on warrants accusing him of tagging property with graffiti, police said Saturday.

Shepard Fairey was arrested Friday on his way to the Institute of Contemporary Art for a kickoff event for his first solo exhibition, “Supply and Demand.”

Two warrants were issued for Fairey on Jan. 24 after police determined that he'd tagged property in two locations with graffiti based on the Andre the Giant street art campaign from his early career, Officer James Kenneally said. One was the railroad trestle by the landmark Boston University bridge over the Charles River, police said.

Fairey, 38, of Los Angeles is scheduled to be arraigned Monday in Brighton District Court, said Jake Wark, a spokesman for the Suffolk District Attorney. Wark said Fairey would also be arraigned on a default warrant related to a separate graffiti case in the Roxbury section of Boston.

Fairey has been in the Boston area for the past two weeks installing the ICA exhibit and creating outdoor art, including a 20-by-50 foot banner on the side of City Hall, according to a museum statement.

The museum said Fairey was released a few hours after his arrest. Boston police confirmed that Fairey had been released, but did not know exactly when or the amount of his bail.

“Shepard Fairey was completely unaware that there were any warrants for his arrest. Had he known, he would have resolved all such issues before the opening of his art exhibit at the Institute of Contemporary Art in Boston,” his attorney, Jeffrey Wiesner, said in an e-mail.

Fairey has been arrested numerous times for drawing on buildings and other private property without permission.

His Obama image is the subject of a copyright dispute with The Associated Press. Fairey argues that his use of the AP photo is protected by “fair use,” which allows exceptions to copyright laws based on, among other factors, how much of the original is used, what the new work is used for and how the original is affected by the new work.

Serial rapist who preyed on prostitutes arrested, police say

GARDEN GROVE – Police have arrested a man they say is a serial rapist who sexually assaulted and robbed several women believed to be prostitutes over a few weeks in the city.

After two patrol officers acted on a pattern of rape victims filing reports and told detectives about the cases, investigators tracked down a man and served an arrest and search warrant Friday morning at his home in the 12600 Block of Buaro Street, said police Lt. Jeff Nightengale.

Two men arrested in Laguna Niguel robbery

Alleged intruders were from San Juan Capistrano, according to authorities.

LAGUNA NIGUEL Two men were arrested on Monday in connection with an early morning robbery in Laguna Niguel on Sunday.

A caller around 6:30 a.m. reported to a dispatcher that someone had broken into his home and had him at gunpoint and knifepoint, according the Orange County Sheriff's Department call log.

The residents, who lived in an apartment complex off Seaspray East, were awakened by four men demanding money, said Sgt. Eric Nester. They took $200, a cell phone, a victim's ID, and an xBox. The total loss is estimated at $500.

As the suspects tried to escape, one resident chased after them with a baseball bat, said Nester. The resident hit the trunk and broke the driver's side window of the robber's tan Honda Accord.

Sheriff's deputies believe the suspects were gang members from San Juan Capistrano, said Nester. The vehicle was later found in San Juan Capistrano.

Jesse Gonzales, 24, and Osvaldo Mendoza, 18, were arrested in connection with the call.
